1. GENERAL INFORMATION
CalmPaws ("Company," "we," "us," or "our") operates as an e-commerce retailer selling the CalmPaws dog ear muffs through its online store. All transactions are conducted exclusively online. For any legal or commercial inquiries, you may contact us at: calmpawshq@gmail.com
We will make reasonable efforts to respond to all written communications within 3 to 5 business days.
2. NATURE OF THE BUSINESS — DROPSHIPPING DISCLOSURE
CalmPaws operates under a dropshipping model. This means that orders placed through our store are fulfilled by third-party suppliers who ship products directly to customers. This arrangement does not affect your consumer rights or the terms of this Legal Notice. CalmPaws remains fully responsible to you, the customer, for all aspects of your purchase, including product quality, delivery, and after-sales support.
3. PRODUCT DESCRIPTION AND INTENDED USE
The CalmPaws ear muffs are designed to wrap snugly around a dog's head to physically attenuate loud sounds that may cause anxiety or distress, including but not limited to fireworks, thunder, grooming sessions, and veterinary visits. The product is lightweight, breathable, and adjustable to fit small, medium, and large dogs. It contains no pharmaceutical ingredients, chemicals, or sprays.
Important Limitations. The CalmPaws ear muffs are a comfort and noise-reduction accessory, not a medical or veterinary device. They are not intended to diagnose, treat, cure, or prevent any medical or behavioral condition in animals. Results may vary depending on the individual dog's temperament, sensitivity, and acclimatization to the product. CalmPaws makes no guarantee of a specific behavioral outcome. If your dog suffers from a diagnosed anxiety disorder or any medical condition, consult a licensed veterinarian before use.
4. ORDER PROCESSING AND SHIPPING
Orders are processed within 1 to 3 business days from the date of purchase confirmation. Estimated delivery time is 13 to 20 business days from the date of shipment. Business days exclude Saturdays, Sundays, and federally recognized public holidays.
Delivery estimates are provided in good faith and are based on typical carrier performance. CalmPaws is not liable for delays caused by third-party carriers, customs processing, force majeure events, or circumstances beyond our reasonable control. Title and risk of loss for products purchased from CalmPaws pass to the buyer upon delivery to the carrier.
If your order has not arrived within 25 business days from the date of shipment, please contact us at calmpawshq@gmail.com so we may investigate on your behalf.
5. RETURN AND REFUND POLICY
5.1 Eligibility Window. Customers who wish to initiate a return must notify CalmPaws by email at calmpawshq@gmail.com within 48 hours of confirmed delivery of the product. Requests submitted after this 48-hour window will not be eligible for a return or refund, except where prohibited by applicable law.
5.2 Condition Requirements. To be eligible for a return, the product must meet all of the following conditions at the time it is received back by CalmPaws:
The product must be completely unopened. The product must be in its original, intact packaging, with all seals, wrapping, and tags undamaged and unbroken. The product must be unused, unaltered, and free from pet hair, odors, stains, or any signs of use or handling beyond initial visual inspection. Any product that does not meet these conditions upon inspection will be rejected and returned to the customer at the customer's expense, without issuance of a refund.
5.3 Return Shipping Costs. All return shipping costs are the sole responsibility of the customer. CalmPaws does not provide prepaid return labels. We recommend that customers use a trackable shipping method, as CalmPaws is not responsible for returned items lost or damaged in transit. Shipping costs from the original order are non-refundable.
5.4 Refund Process. Once the returned product is received, CalmPaws will inspect it within a reasonable period not to exceed 5 business days. Refunds will be issued only after inspection confirms that all eligibility conditions set forth in Section 5.2 are fully met. Approved refunds will be processed to the original payment method. Please allow 5 to 10 business days for the refund to appear in your account, depending on your financial institution.
5.5 Non-Returnable Items. Products that have been opened, used, damaged by the customer, or received more than 48 hours prior to the return request are not eligible for return or refund.
6. LIMITED 90-DAY WARRANTY
CalmPaws warrants that the CalmPaws ear muffs will be free from defects in materials and workmanship for a period of 90 days from the date of delivery to the original purchaser. This warranty applies only to manufacturing defects and does not cover damage resulting from normal wear and tear, improper use, accidents, modifications, or use contrary to the product instructions.
To make a warranty claim, contact us at calmpawshq@gmail.com within the 90-day warranty period and provide a description of the defect along with photographic evidence. If the claim is validated, CalmPaws will, at its sole discretion, repair or replace the defective product, or issue a full or partial refund.
This warranty is non-transferable and applies only to the original purchaser. It does not extend to any third party.
Disclaimer of Additional Warranties. EXCEPT AS EXPRESSLY SET FORTH ABOVE, CALMPAWS MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
7. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CALMPAWS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, VETERINARY COSTS, OR ANY INJURY TO ANIMALS OR PERSONS, ARISING OUT OF OR IN CONNECTION WITH THE PURCHASE OR USE OF THE PRODUCT, EVEN IF CALMPAWS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL CALMPAWS'S TOTAL CUMULATIVE LIABILITY TO ANY CUSTOMER EXCEED THE AMOUNT ACTUALLY PAID BY THAT CUSTOMER FOR THE PRODUCT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in their entirety.
8. CONSUMER PROTECTION COMPLIANCE
Federal Trade Commission (FTC). CalmPaws operates in compliance with the FTC Act, 15 U.S.C. § 41 et seq., and all applicable FTC regulations and guidelines, including those relating to online advertising, endorsements, and unfair or deceptive trade practices.
CAN-SPAM Act. Any commercial email communications sent by CalmPaws comply with the CAN-SPAM Act, 15 U.S.C. § 7701 et seq. Recipients may opt out of marketing communications at any time by following the unsubscribe instructions included in each email.
State Consumer Protection Laws. Customers may have additional rights under the consumer protection laws of their state of residence. Nothing in this Legal Notice is intended to limit or waive any rights that cannot be contractually excluded under applicable state or federal law.
9. DISPUTE RESOLUTION
In the event of any dispute, claim, or controversy arising out of or relating to your purchase from CalmPaws or this Legal Notice, we encourage you to first contact us at calmpawshq@gmail.com to seek an informal resolution. We will make good-faith efforts to resolve any complaint within 10 business days.
If informal resolution is not achieved, any dispute shall be resolved through binding arbitration administered under the rules of the American Arbitration Association (AAA) in effect at the time of the dispute, unless you are a consumer bringing a small claims action, in which case you may pursue that action in a court of competent jurisdiction. By purchasing from CalmPaws, you waive the right to participate in any class action lawsuit or class-wide arbitration.
10. GOVERNING LAW
This Legal Notice and any dispute arising from your use of the CalmPaws store or purchase of the CalmPaws product shall be governed by and construed in accordance with the laws of the United States of America and applicable federal regulations, without regard to conflict of law principles.
11. INTELLECTUAL PROPERTY
The name "CalmPaws," all associated logos, product imagery, website content, and marketing materials are the exclusive property of CalmPaws and are protected under applicable trademark, copyright, and intellectual property law. Unauthorized reproduction, distribution, or commercial use of any CalmPaws intellectual property is strictly prohibited and may result in legal action.
12. MODIFICATIONS TO THIS NOTICE
CalmPaws reserves the right to modify, update, or amend this Legal Notice at any time, at its sole discretion. Changes will be effective upon publication to the CalmPaws online store. Your continued use of the store or purchase of products following any modification constitutes your acceptance of the revised terms. We encourage you to review this Legal Notice periodically.
